PETITION  FOR  GRANT  OF  SUCCESSION  CERTIFICATE
U/S 372  OF  SUCCESSION   ACT  1925 IN RESPECT OF DUES/
DEBTS/ SECURITY BELONGING TO  DECEASED
X S/O. S MASIH

The Petitioner above named respectfully submits as under :-
1.     That the above named deceased  X Masih S/o S Masih   who was husband of the petitioner and died at Karachi on 29.3.2011.

Photo cop of Death Certificate of deceased and marriage certificate are annexed herewith and marked as annexure “A” and “A/1” .

2.     That the said deceased resided at R/O House No. 12, Street No. 25, Sector A-, O Crossing  Karachi within the local limits of P.S. Zaman Town  which is  with in the jurisdiction of this Hon’ble Court.

3.     That the deceased at the time of his death was working in Pakistan Navy as a Sailor.

4.     That the said  deceased was  having insurance of Rs.6,484,000/-  (A) General Group Insurance (GGI)  Rs.4,84,000/- (B) and Additional Group Insurance ( AGI) Rs.2,00,000/- which is separately shown in Schedule “B”. Letters of Group Insurance claim are attached herewith marked as annexure “B/1” and “B/2”.

5.     That the said deceased at the time of his death left behind following surviving  legal heirs as  his  next to kin according to  Christian Personal  Law as:-.

6.     That the Petitioner as wife of deceased is entitled to get share according to Christian law and the other legal heirs have no objection if the succession certificate is granted to the Petitioner.

7.     That the said deceased died intestate and diligent search has been made for a will but none has been found.

8.     That no application or petition for grant of Succession Certificate or probate in respect of said dues/ debts/ securities of the said deceased have ever been made to any Court of law and there is no impediment U/s 370 or under any provision of succession act or of other enactment to the grant of the said certificate under law.

9.     That affidavit of two independents witnesses/ relatives of deceased are filed herewith marked as annexure “C” and “D”, respectively.

10.                        That proper Court fees prescribed under the law has been affixed on the Application.
PRAYER

It is prayed that this Hon’ble Court may be pleased to grant succession certificate in the name of Petitioner without requiring her to furnish security.
